FAQs
Let’s Resolve Your Workplace Conflict
How does mediation work?
Private meetings take place with the parties involved, followed by short check-in meetings before the main joint meeting. Discussions take place in a structured manner with the mediator facilitating the exploration of the key issues, an understanding of the different positions and a joint agreement to workable solutions to move forward.
Mediation can take place in-person or on a remote basis.
Is mediation confidential?
Yes, confidentiality is of upmost importance in mediation. Lack of confidentiality (perceived or not) is the main barrier to employees not wishing to engage in discussions which is why external mediation works so well. After the joint session, the mediator will produce an agreement which reflects the agreed outcomes. It is up to the parties if they wish to disclose this document with the company. The agreement is not legally binding but in a small number of cases, this will be requested.
How long does it take, is it cost effective?
Most cases can be settled within 6-8 hours over a period of one week. Mediation is therefore a very cost- effective and efficient way of dealing with conflict in the workplace.
Can mediation take place between employees in different countries?
Yes. In today’s world, many companies have employees working together and/or reporting to individuals in different countries. Mediation can take place online and therefore can easily accommodate cases where individuals may be based in different countries. Some countries may have regulations around mediation and this would need to be checked before engagement.
